Supreme Court justices are supposed to be nonpartisan and should aim to be objective. They also should be dignified and restrained enough to not make political statements, whether those comments are leaning toward the left or the right.
But, Supreme Court Chief Justice John Roberts ignored that tradition the other day when he had some choice words for President Trump after the commander-in-chief criticized the district and appellate court judges on the 9th U.S. Circuit Court of Appeals.
The spat came after Jon S. Tigar, U.S. District Judge in San Francisco, issued a nationwide injunction that would block the president’s restrictions on the Central American migrant caravan.
“This was an Obama judge, and I’ll tell you what, it’s not going to happen like this anymore,” the president said. “Everybody that wants to sue the U.S. – almost – they file their case in the 9th Circuit, and it means an automatic loss. No matter what you do, no matter how good your case is. And the 9th Circuit is really something we have to take a look at, because it’s not fair.”
This is when Roberts fired back in what looked like an attempt to defend one of his own.
“We do not have Obama judges or Trump judges, Bush judges or Clinton judges. What we have is an extraordinary group of dedicated judges doing their level best to do equal right to those appearing before them,” Roberts said.
Naturally, President Trump responded in kind.
“Sorry Chief Justice John Roberts, but you do indeed have ‘Obama judges,’ and they have a much different point of view than the people who are charged with the safety of our country,” Trump said. “It would be great if the 9th Circuit was indeed an ‘independent judiciary,’ but if it is why are so many opposing view (on Border and Safety) cases filed there, and why are a vast number of those cases overturned. Please study the numbers, they are shocking. We need protection and security – these rulings are making our country unsafe! Very dangerous and unwise!”
One thing that really stands out about Roberts’ strong and public opinions is that he typically stays out of the limelight in that way, and does not make open politically charged comments like he just did toward Trump.
It is curious indeed that Roberts was appointed by George W. Bush, a Republican president, and is coming out with disagreement toward another Republican president. Meanwhile, he didn’t let out a peep when there were times he could have disagreed with President Obama.
Roberts needs to stick to his job and let Trump do his — handling the complex problem that is unfolding at the U.S. border.

Obama is also experienced at using judges to weaken the government. He learned from an insider. Obama praised Judge Abner Mikva as one of his important mentors. Birds of a feather….. I remember Mikva’s appointment..
Congress created 152 new federal judges with the Omnibus Judgeship act of 1978. A key provision was serving members of Congress could not be nominated for those positions. Jimmy Carter signed it into law and the next morning nominated serving Congressman Abner Mikva, (D-IL). Ted Kennedy, head of the Senate Judiciary Committee immediately opened a committee hearing to confirm him but shut it down when confronted that Mikva, a serving congressman, could not be nominated. A couple hours later, Kennedy held a closed door meeting with the democrat committee members. They voted to confirm Mikva, put him in a limo, drove to DOJ, and swore him in as a judge as soon as he stepped out of the car. Even if a federal judge is appointed illegally, the only way to remove them is for Congress to vote to impeach them. So much for all the Democrats screaming about following laws, etc.
So the judiciary was being subverted way back then. Seems there was a very long term plan being put into effect by the political “elite”…

I certainly no longer think of him as an unbiased arbiter of the law which is what he is supposed to be. He can have any personal opinion he wants as long as he keeps those opinions to himself. Chief Justice Roberts is a Federalist, not a conservative. It is unfortunate he has revealed his predeliction for upholding the power of district courts to issue nationally sweeping decisions. Congress has authority under the Constitution to determine jurisdiction of the Court and should act immediately to limit district court jurisdiction to no more than the Circuit in which that court is located.
Roberts, indeed, is an Obummer judge although he wasn’t appointed by Obummer. The judges that are appointed do have leaning toward those that appoint them. Each President has looked for certain beliefs in those they have appointed. Therefore, there are liberal leaning judges and conservative leaning judges. I know you judges can understand how this works.

This is the same guy, Injustice Roberts, who took it up on himself to rewrite the Obamacare Law wording to make it legal to impose on all Americans who work for a living. While the Obama attorney general’s office argued, before the U S Supreme Court, an oxymoronic name for these folks, that the law set up a monetary penalty, to be collected by the IRS from citizens who did not have the required insurance coverage, a non tax monetary penalty, Justice Roberts changed the law’s wording to call this penalty a tax. If there was no tax clause then Congress could not assess any penalty from those who did not have the insurance coverage that was required to avoid this no tax penalty. But Congress does have the Constitutional authority to tax. Where does the U S Supreme court have the Constitutional authority to make and pass laws? IT DOES NOT. What a sham we have as a government now. We have now transed from Republic to a Banana Republic folks. What a shame to see such a great experiment die.

We are at the start of “Judicial Tyranny”. P.O.T.U.S. cannot do his constitutionally outlined job due to Judges that ignore the Constitution. When a Supreme Court Justice comments on a political issue they destroy their ability to adjudicate from a position of impartiality which is paramount for the credibility of their decisions.
Otherwise, they simply become a part of the political scene. While they may disagree with a given statement by any political figure from the President on down their opinions should and must be their own and not shared with the public.
It is indeed unfortunate that people with access to the press due to either their work or notoriety use their status as a platform to espouse their opinions, and the rest of us have little or no recourse for equal response exposure.
Interesting last comment about Trump doing it without pay.” No doubt he is supposed to be doing it without pay other than his presidential salary. But I quote, “Do I like the Saudis? Of course I do, they spend millions with me.”

Roberts is showing his liberal side again, once thought to be a solid conservative proved to be false when he changed Obama’s healthcare from a fine to a tax therefore allowing it to go through. That was in 2012 and in 2016 he again proved false conservative when he made another decision favoring Obama. If Trump gets one more appointment let’s say replacing the old geezer Ginsberg if she retires or goes to valhalla we should push for a new leader.

Of course Justice Roberts understands that many Judges are ideologically driven; that Obama appointed very biased Judges. He is simply turning a blind eye to that reality, to voice an idealized picture of how he wishes reality was. We should not emphasize the error, he has deliberately made to try to prove a point. No one, right or Left is really misled by his effort to address what is no better than his personal wish list.

Mr. Winters, please get your facts straight. The majority of our people did not vote for Mr. Trump. He received a majority of the electoral college because of the way our country is gerrymandered. Clinton received (I believe) approximately 3 million votes more than Trump.

Nixon had the same problem with his Atty. General as well as with his Solicitor General Archibald Cox. You remember Nixon, don’t you – the President in the 1970’s who resigned rather than face impeachment.
Trump picked Whittaker without Senate approval without taking into account that Whittaker was and is being investigated by the FBI for defrauding the public out of millions of dollars. It’s ok to ignore all that because Whittaker previously said that the President shouldn’t be indicted. My oh my — that really qualifies him to be a good Atty. It is quite obvious from what people have written that they believe as I do that justice Roberts should resign. Civil wars don’t happen overnight they are stoked by people like Justice Roberts and those who are part of the dark states. When it comes time to clean house He will be just another name on the list. If this bunch has their way we will be another Venezuela or worse.
It’s time for Trump to set up a military tribunal, declassify all the documents and try those for treason And other crimes. Sooner than later.

Although I have not agreed with all of Justice Roberts’ decisions, there is no way that I or any reasonable person could consider him to be responsible for instigating civil division within our country. Trump is the only one who can be legitimately accused of that. If you watched the funeral services for President Bush, it was obvious that he was being shunned by ALL the other RESPECTED presidents.
